Rental of Our Artwork
Luxpeer agrees to rent the artwork described on the Website (the “Artwork“) to the Renter for the agreed-upon rental period (the “Rental Period“).
The Renter acknowledges that Luxpeer is the sole owner of the Artwork and has the right to rent it.
Rental Period and Fees
The Rental Period will commence on the agreed-upon start date and will continue until the agreed-upon end date, as specified on the Website.
The Renter shall pay the rental fee (the “Rental Fee“) for the Artwork, as specified on the Website. The Rental Fee includes the cost of renting the Artwork for the entire Rental Period.
The Renter agrees to pay the Rental Fee in advance through the payment methods available on the Website.
Care and Maintenance
The Renter agrees to handle the Artwork with the utmost care and to protect it from any damage, loss, theft, or vandalism during the Rental Period.
The Renter shall not alter, modify, or make any additions to the Artwork without Luxpeer’s prior written consent.
If the Artwork is damaged during the Rental Period due to the Renter’s negligence, the Renter shall be responsible for the restoration costs, as determined by Luxpeer.
Shipping and Insurance
Luxpeer will arrange for the shipment of the Artwork to the Renter’s specified location before the Rental Period commences and for the return of the Artwork at the end of the Rental Period.
The Renter shall inspect the Artwork upon receipt and notify Luxpeer of any damages or discrepancies within 48 hours.
Luxpeer will provide insurance coverage for the Artwork during transit. However, during the Rental Period, the Renter shall be responsible for insuring the Artwork against loss, damage, or theft at their own expense.
Liability and Indemnification
Luxpeer shall not be liable for any damage, loss, theft, or injury arising from the Renter’s use or possession of the Artwork during the Rental Period.
The Renter agrees to indemnify, defend, and hold Luxpeer harmless from any claims, damages, liabilities, or expenses arising out of or relating to the Renter’s use of the Artwork.
Termination
Either party may terminate this Agreement in the event of a material breach by the other party. Termination shall be effective immediately upon written notice.
Upon termination, the Renter shall return the Artwork to Luxpeer in the same condition as it was received, normal wear and tear excepted.
Entire Agreement
This Agreement constitutes the entire agreement between Luxpeer and the Renter concerning the rental of the Artwork and supersedes all prior agreements and understandings, whether oral or written.
Artwork Sale Agreement
This Artwork Sale Agreement (the “Agreement”) is entered into between Luxpeer (“Seller” or “Luxpeer”) and the individual or entity (“Buyer” or “You”) seeking to purchase artwork from Luxpeer. By accessing and using the Luxpeer website (the “Website”) and entering into this Agreement, you agree to be bound by the terms and conditions set forth below.
Artwork Description
1.1 Luxpeer agrees to sell the artwork described on the Website (the “Artwork“) to the Buyer.
1.2 The Buyer acknowledges that Luxpeer is the sole owner of the Artwork and has the right to sell it.
Purchase Price and Payment
2.1 The purchase price for the Artwork (the “Purchase Price“) is as specified on the Website.
2.2 The Buyer shall pay the Purchase Price through the payment methods available on the Website.
2.3 Upon receipt of the full payment, Luxpeer will arrange for the delivery of the Artwork to the Buyer.
Delivery and Risk of Loss
3.1 Luxpeer will use commercially reasonable efforts to deliver the Artwork to the Buyer at the agreed-upon location.
3.2 The risk of loss or damage to the Artwork shall pass to the Buyer upon delivery. It is the Buyer’s responsibility to inspect the Artwork upon receipt and notify Luxpeer of any damages or discrepancies within 48 hours.
Ownership and Title
4.1 Ownership and title of the Artwork shall transfer to the Buyer upon receipt of the full payment.
4.2 Until full payment is received, Luxpeer retains ownership and title to the Artwork.
Artwork Condition and Authenticity
5.1 Luxpeer represents and warrants that the Artwork is in the condition described on the Website at the time of sale.
5.2 Luxpeer further represents and warrants that the Artwork is authentic and that it has the legal right to sell the Artwork.
